(AP) - Eight eBay sellers were ordered to pay nearly $90,000 in restitution and fines after admitting they bid up products online to inflate the prices. New York Attorney General Eliot Spitzer said more than 120 people will receive restitution in the settlement of the three cases, which wrapped up last week in state courts. Spokesman Darren Dopp said the cases stemmed from specific complaints, but the office has not conducted a broad investigation of the online auction industry and doesn't know how widespread the practice of phony bidding is. One buyer, Brad Clarke, 48, of Peachtree City, Ga., already has received a check for $3,089 after overpaying for a 1999 Jeep Cherokee sport utility vehicle he bought on eBay from a New York seller in 2002. ``I'd always been suspicious because it seems like an easy thing to do, to just keep bidding up,'' Clarke said. ``But I was still just completely shocked and very surprised.'' Three sellers were accused of making 610 bids on 106 of their car auctions under the user name ``Mother's Custom Automotive NY Dealer.'' They are paying more than $28,000 in penalties and restitution, Spitzer said. Their lawyers declined to comment. In another case, the operator of an art auction house and two former employees were accused of bidding on more than 1,100 of each others' eBay items for more than five years to drive up the prices. Some paintings sold for thousands more than they were worth. Spitzer said one of the sellers pleaded guilty to a felony charge, the other two to misdemeanors. They were ordered to pay more than $50,000 in restitution and fines. The other two defendants were accused of making 170 phony bids on their sports memorabilia items. They agreed to pay $10,000 in penalties and restitution. I relisted my ebay listing for beginning collectors and continue to get responses, which I think is great. I was sort of looking for ebay to pull it or tell me it wasnt acceptable, but havent heard anything of the sort. If they do say something, I am going to ask why they sanction mail fraud, which in my opinion, is what the sellers of fakes are commiting when they put a misrepresented piece in the mail. In fact I got one yesterday. Some of the other shop owners fell for it initially and warned us all. If it sounds to good to be true, it is. They did arrest 8 people last year but it is still going strong. You really have to trust your instincts. If it sounds fishy it probably is. Another thing to worry about. One of the shop owners was contacted about an expensive Roseville vase she had. The customer was in her area and would like to see all her Roseville, could he come over and maybe buy them all? She agreed and he came to her home with his "wife & son" bought everything she had and paid with a travelers check or something like that. Well, the check was no good, the name was phony and she is out a few thousand dollars of merchandise plus now is afraid because they know where she lives. These are all things you have to be aware of when you sell either on line or in a brick and mortar. Its a sad world. This of course assuming that all merchants require the CVV, which they SHOULD!!! Lastly, all CC purchases made in person should require that you present your drivers license (photo id) to the merchant at the time of purchase along with your CC. I was in Vegas recently and noticed that they do this EVERYWHERE!!!!!!!! Any time I made a CC purchase, whether at a Mall, or restaurant, a PHOTO ID was required! Anyway, another thing to keep in mind is that the consumer is 100000000000% protected by fraud when using a CC. They are protected from bad purchases, basically anything. The merchant always loses with a CC. The consumer can chargeback anything, and almost always wins a chargeback. Food for thought! Like many others, I enjoyed the food and fun today. And McQuita, I appreciate you reminding us of the real deal. To me, the real meaning of Thanksgiving is that this is the day to "officially recognize" that all good things come from above. I'm so thankful for my faith, great kids, a great family, good health, I'm not a pauper, and I live in a free country. And I pray I'll become more and more thankful, and never, ever take any good thing for granted. I had a great time with my family today at lunch. ("Dinner" to those of us here in the southeast). Now, I'm going over for supper with some old friends who are here in Tennessee, visiting from Florida. I hope y'all don't mind if I get "personal" ... We've all got something to be thankful for, even my 85 year old grandmother who got hurt. Last week, she was hanging some draperies in her house (... I call them "sheers" ??). She was walking with the rod held high above her head (but not high enough, apparently) and tripped on one of them and fell onto the corner of her coffee table and broke 2 ribs. After 2 days in the hospital and some tests, she's now in the nursing home. *NOT* for good - but for therapy of some sort. I stopped by to visit her again today, and she's still in good spirits. Last week, she said that as soon as she fell, she thanked the Lord that she didn't hurt/break her hip - or back - or neck. When I've visited her there in the nursing home, she says something about "all these poor, pitiful people who have to stay here for the rest of their days. I feel so sorry for them." Of course, broken bones are painful. But - broken ribs for an 85 year old?! It *has* to be very frustrating when taking more than a shallow breath is very painful. And speaking of frustration ..... anyone who has to push a button - and then wait, sometimes several minutes - every time you need to "go" is very inconvenient, to say the least. But she's got such a good attitude. I can tell it's very difficult for her, but she's in very good spirits, and *I* think it's because she CHOOSES to be. That's the way she's always been. Of course, she has had times in life when it was impossible not to cry, etc., but ....... I'll just sum this up with something I've learned by observing her life, as well as a few other people. Some of the best ways of coping with bad times are; 1). prayer 2). helping others who are worse off, and 3). finding something to laugh about even when you feel like screaming your lungs out. I just said all of this to remind everyone that we can always be thankful because there are always people who are worse off, no matter how bad things are. Mark J. >I bet they do smell good! I think you hit on some very important guidelines there...life truly isn't a bowl of cherries...but life itself is such a blessing. Your Grandmother sounds like a wonderful lady and I wish the best for her... Don't ever take someone you love for granted...cherish them...and let them you care for them. Mom's been gone slightly more than a year and sometimes it hits me so hard I can do nothing but cry...she knew I loved her and I know she loved me...and that's a blessing, too. If your mom's are alive, please call and tell them you love them. Cherish your family and friends. t From damitboy@yahoo.com Thu, 25 Nov 2004 18:47:34 -0800 (PST) Date: Thu, 25 Nov 2004 18:47:34 -0800 (PST) From: david mcCoy damitboy@yahoo.com Subject: [Mccoypottery-talk] RE: Thanksgiving Hi Mark, I would like to thank you for this letter. It reminds me of all the good things I learned from my grandmother in germany. She passed away at 93 years of age, at home, in peace. She was probably the most religious person I have ever known. She was in church everyday, and told me many times, that when she passed away, she wished it would be in the church. Well she wasnt far away. The village my family lives in is very small and the chruches front door was about 30 yards away. She went through many rough times in her life, she lost a 4 year old child during WW2, had to scrounge for food most of the war and raise 8 other children, including my mother. WE spoke about her today, and realised just how fortunate we are to live in a country like ours. We also gave thanks for our troops, who do their jobs without a hint of complaint, and with honor. Oh and by the way, that corn casserole was some kinda good. If anyone wants it, let me know, super simple to make and quite tasty. Dave --------------------------------- Do you Yahoo!? Kindly > remove me. > I think there is some misunderstanding here. Exchanging links amongst web sites is a fairly common thing, actually it always has been. That is how the internet started, that is what makes it work, and that is what we are talking about. Adding a link to a site like McCoyPottery.Com which gets a lot of visits, affords others who are linked to the site the opportunity to share in that traffic and visa versa. If you do not have a web site, ignore the thread. If you do, and it is McCoy related, then we encourage you to link to our site, as we will add a link on our site to yours. There is no "list", it is a "link", there is no "spam", it is a "link" Here is a little definition on what a "link" is: Short for "hyperlink." Links are commands used to jump from Web page to Web page. If you didn't have links, you wouldn't be able to get from one Web page to another. Because links can lead to a page either related to the one you're on or to one completely unrelated, links have made linear thought on the Web pretty much an option, not a rule. Therefore, it is because of the link (and hypertext in general) that the Web is such a unique medium. Sometimes links appear as an underlined, colored word or group of words; sometimes they're a picture; sometimes they're icons, which are like pictures but usually more functional. Just remember that links are made to be clicked (and are therefore "clickable"). If you get a message bounced for spam there is a specific error code/reason listed in the bounce message, none of which say anything about court, or any implication of court.
